**Effective October 30, 2026**

These terms are an agreement between you and **Mobius Ventures, LLC**, doing business as **daemn** ("daemn", "we", "us"). These terms cover daemn.one and the daemn apps reached from it, Gather among them (together, the "Services"). Please read them. When you first sign in, and whenever we change these terms in a way that matters, we ask you to accept them before you keep using the apps. If you do not agree, do not use the Services.

# 1. Who may use daemn

- You must be at least **18 years old** to create an account or use the apps. Anyone may read daemn.one's public pages.
- If you use daemn on behalf of a business or other group, you confirm that you may accept these terms for it, and "you" includes it.
- You may not use daemn if the laws of the United States or of the place you live bar you from doing so.

# 2. Your account

- You sign in through our sign-in provider, Auth0 (by Okta). You are responsible for keeping your sign-in method secure and for what happens under your account. If you think someone else has used it, tell us at [daemn256+privacy@gmail.com](mailto:daemn256+privacy@gmail.com).
- An account can belong to one or more **spaces**: a household, a team, or just you. A space's admin decides who joins it and which apps it uses.
  - What you put in a space's shared apps can be seen by that space's other members, as each app shows.
  - Your private items, such as your assistant conversations, are visible only to you.
- You may stop using daemn at any time. To close your account and have your data deleted, write to the address above. We delete it within 30 days, as our [Privacy Policy](/privacy) explains.

# 3. Free today, paid plans later

- Every app is free to use today, within limits we set (for example, a daily allowance for the AI features). We may change those limits.
- We may later offer **paid plans**. Before you pay for anything, we will show you the price, what it includes, how it renews and how to cancel, and you will agree to those plan terms separately. Nothing in these terms makes you pay for anything.

# 4. Using daemn fairly

You agree not to:
- break the law, or use daemn to harm, harass, deceive or spam anyone;
- upload content you have no right to share, or content that infringes someone else's rights;
- try to get into accounts, spaces or data that are not yours, or probe, scan or test daemn's security without our written permission;
- overload, disrupt or reverse-engineer the Services, or get around their limits, including the AI features' allowance;
- use the AI features to produce content that breaks [Anthropic's Usage Policy](https://www.anthropic.com/legal/aup), which applies to anything sent to Claude through daemn;
- resell the Services, or give others access to them, except as the apps allow.

We may remove content or suspend an account that breaks these rules. Where it is fair and safe to do so, we will tell you why.

# 5. Your content

- What you create in daemn (recipes, lists, notes, records, messages and the rest) stays **yours**.
- You give us permission to store, copy, process and display it **only as needed to run the Services for you** and for the people you share it with. That includes sending it to the service providers named in our [Privacy Policy](/privacy), such as Anthropic when you use an AI feature.
- **We do not sell your content. We do not use it to train AI models, and our AI provider does not either.**
- You are responsible for your content and for having the right to put it in daemn (for example, recipes you import from elsewhere).

# 6. The AI features

Some features are powered by **Claude, a model made by Anthropic**. Today these are Gather's Ask (the assistant), recipe reading and ingredient-line fixes, and Finance's Ask about a topic. When you use one:

- **What you type is sent to Anthropic** to produce the answer. If you dictate, your device turns your speech into text, and only the text is sent. [How the AI features work](/apps/gather/ai) and our [Privacy Policy](/privacy) give the details.
- **AI output can be wrong.** It may misread a recipe, get an amount or a conversion wrong, or miss an allergen. Check what it gives you before you rely on it, especially for allergies, dietary needs, food safety and money.
- When the assistant changes something for you (for example, it adds a list item), the app tells you what it did. You are responsible for what you keep.
- The AI features may be switched off, limited or changed at any time, and may not be available on every plan.

# 7. Not professional advice

- **Gather** gives you recipes, amounts, conversions and cooking help. It is not medical, nutritional or allergy advice. If you, or anyone you cook for, has an allergy or a medical diet, always check the ingredients and labels yourself.
- **Finance** helps you research and keep notes. Market and filing data shown in it comes from third parties, may be delayed or wrong, and is for information only.
  - **Nothing in daemn is investment, tax, legal or financial advice**, and nothing in it recommends buying or selling anything.
  - We are not a broker, an adviser or a financial institution, and daemn does not connect to your bank or brokerage accounts.

# 8. Our property

daemn's software, design and name, and the content we write, belong to us or our licensors. These terms give you a personal, non-exclusive, non-transferable right to use the Services as offered, and no other rights in them. If you send us feedback or ideas, we may use them freely.

# 9. Changes to daemn and to these terms

- We improve daemn all the time, and may add, change or remove features.
- If we change these terms **in a way that matters** to you, we will show you the new version and ask you to accept it before you keep using the apps. We record which version you accepted and when.
- We publish changes that do not affect your rights (a typo, a clearer sentence) without asking you again. Every version stays readable on this page.
- A change never applies to a dispute that started before it took effect.

# 10. Ending

- You may stop at any time (section 2).
- We may suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or if we stop offering a Service. If we stop a Service, we will try to give you reasonable notice and a way to export your content first.
- Sections 5, 7, 8, 11, 12 and 13 survive the end of these terms. Your permission in section 5 ends, except for copies kept in backups for a limited time.

# 11. No warranty

daemn is provided **"as is" and "as available"**. To the fullest extent the law allows, we make no promises about the Services beyond what these terms say. In particular, we do not promise that they will be uninterrupted, error-free, secure or fit for a particular purpose, or that AI output or market data will be accurate. Some places do not allow these exclusions, so some of them may not apply to you.

# 12. Limits on our liability

To the fullest extent the law allows:
- we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill; and
- our total liability for any claim about the Services is limited to the greater of **the amount you paid us in the 12 months before the claim, or US $50**.

These limits do not apply where the law does not allow them.

# 13. Disputes

- These terms are governed by the laws of **the State of Georgia [to confirm]** and of the United States, without regard to conflict-of-law rules.
- Before filing a claim, please write to us so we can try to fix the problem; we will do the same for you.
- Either of us may bring a claim in **small-claims court** where it qualifies. Otherwise, claims go to the state or federal courts in **[COUNTY — to be set], Georgia**, and we both consent to their jurisdiction.
- If you are a consumer, nothing here takes away rights that the law of the place you live gives you and that cannot be waived.

# 14. Indemnity

If you use daemn on behalf of a business, that business will defend and indemnify us against third-party claims arising from its content or from its breach of these terms.

# 15. Copyright complaints

If you believe content in daemn infringes your copyright, write to the address above with the details listed in 17 U.S.C. § 512(c)(3).

# 16. The rest

- These terms, the [Privacy Policy](/privacy) and any plan terms you accept are the whole agreement between us about the Services.
- If a part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a term straight away, we have not given it up.
- You may not transfer these terms. We may transfer them to someone who takes over the Services, and will tell you if we do.
